Erosion & Sediment Control Program

The City of Henderson is committed to protecting our environment through the administration of an Erosion and Sedimentation Control program. This program applies to all development within city limits but does not extend to the Extra Territorial Jurisdiction (ETJ). For projects in the ETJ, developers must file for an erosion control permit with the State of North Carolina. Our program operates under the guidance of the North Carolina Department of Environmental and Natural Resources (NCDENR), enforcing the Sedimentation Pollution Control Act of 1973 through Chapter 23A of the City’s Soil Erosion and Sedimentation Control Ordinance.


If your project involves land disturbance exceeding 0.5 acres (or 1 acre for single-family residences), you’ll need to submit an Erosion and Sedimentation Control plan for approval before beginning work. These plans must adhere to the standards outlined in the NCDENR Erosion & Sediment Control Planning and Design Manual. Projects smaller than these thresholds do not require a formal plan but must still comply with erosion control measures to prevent damage to surrounding properties and the environment.
